Qingdao Jindayang Dairy Co., Ltd. (hereinafter referred to as "Jindayang"), which is suspected of selling solid beverages as special medical food, began to remove the products from the shelves and start a recall. On May 18, Jindayang announced on its official WeChat account that the company would implement a three-level recall of related products because the product labels did not comply with the Food Safety Law.

 

　　Although Jin Dayang has repeatedly stressed that the production of solid beverages meets regulations, in the opinion of industry insiders, in terms of sales and publicity, Jin Dayang sells solid beverages in the name of special medical food and special milk powder, misleading consumers, solely due to non-compliance with product labels, which is suspected of evading responsibility.

 

　　Initiate a recall

 

　　On May 18, Jin Dayang announced on the official WeChat official account that the company will initiate a three-level recall of "small peptide formula powder in jaundice stage and amino acid formula powder series in allergy stage of various food proteins" produced from May 15, 2017 to May 13, 2019 because the product label does not comply with the food safety law. The recalled products include 6 products from 5 brands of "Jin Dayang Teneng", "Jin Dayang Belkang", "Jin Dayang Baby Kang", "Jin Dayang Seaside" and "Love Belle".

 

　　Specific products include Tenenshu Jaundice Phase Peptide Formula Powder, Tenenshu'an Multiple Food Protein Allergy Phase Amino Acid Formula Powder, Shu'an Multiple Food Protein Allergy Phase Amino Amino Acid Formula Powder, Jindayang Yanershu Multiple Food Protein Allergy Phase Amino Acid Formula Powder, Jindayang Ammonia Kangbao Multiple Food Protein Allergy Phase Amino Acid Formula Powder. The above products are mainly sold to Beijing, Shanxi, Shandong, Hebei and Tianjin.

 

　　On May 14, Jin Dayang and Ningbo Teyi Food Co., Ltd. (hereinafter referred to as "Ningbo Teyi") were exposed by the media that their related products were sold in major hospitals and surrounding stores with solid drinks posing as special powder, but they did not actually obtain special medical food registration qualifications. Subsequently, Jin Dayang and Ningbo Teyi were investigated by relevant regulatory authorities.

 

　　According to the Qingdao Huangdao District Market Supervision and Administration Bureau's "Circular on Qingdao Jindayang Dairy Co., Ltd.'s Suspected Solid Beverages Pretending to Be Special Medical Food", after a preliminary investigation, the company is suspected of labeling violations and has filed a case, ordering the company to immediately stop production and operation and recall the illegal products sold. The inventory of suspected illegal products will be seized for sampling and testing. The next step will be based on the investigation and testing situation, and will be dealt with seriously in accordance with laws and regulations.

 

　　For the recall, a Beijing Business Daily reporter called Jin Dayang's official website as a consumer. Jin Dayang customer service personnel said that the recall is due to defects in the product label, and the company's products are produced in compliance with the standard of solid drinks, which is legal, not special medical food or special milk powder. For more questions, the customer service said that he is a nutrition consultant, and other questions need to be consulted by sales, and he cannot answer them.

 

　　Beijing Business Daily reporters logged on JD.com, Tmall and other e-commerce platforms and found that Jin Dayang's related products could not be searched on various e-commerce platforms. On Jin Dayang's official website, there were no promotional words such as "special powder" and "special medical food".

 

　　In response to label non-compliance and other related issues, the reporter contacted Jin Dayang by email and phone, but as of press time, no reply had been received. At the same time, the reporter connected to the government service hotline of Qingdao Huangdao District Market and Quality Supervision Bureau. The staff said that the relevant problems would be reported to the relevant departments, but the relevant departments did not reply as of press time.

　　Although there is no authoritative conclusion on the use of solid beverages as special medical food and special powder, Jin Dayang only believes that the label contains false information, but since its establishment, Jin Dayang has positioned itself as special medical food and special milk powder.

 

　　Founded in 2000, Jin Dayang is a comprehensive production enterprise integrating science, industry and trade, import and export, according to Tianyancha data. Jin Dayang's business license includes the sale of beverages; the production and sale of "special medical use formula food"; dairy products, etc. However, in the business license, it is emphasized that "projects that must be approved according to law can only carry out business activities after being approved by the relevant departments", which means that the production and sale of "special medical use formula food" requires a license from the relevant departments to carry out business.

 

　　However, the Beijing Business Daily reporter found that Jin Dayang had never obtained a special medical food production license and was not qualified to produce special medical food by inquiring about the published special medical food registration information and the administrative license of the national enterprise credit information publicity system.

 

　　According to the "Food Recall Management Measures", the third-level recall refers to food with false labels and labels. Food producers should initiate the recall within 72 hours after learning of the food safety risk and report the recall plan to the local food and drug supervision and administration department at or above the county level. Food with defective labels and labels that will not cause health damage after consumption should be corrected by food producers and can be recalled voluntarily.
